Release of Liability, Waiver of Legal Rights and Assumption of Risk

In reference to Tandem and Solo Flight Instruction, Ground School, Ground Instruction, Tandem and Solo Towing (of any sort), Tandem and Solo Foot Launching, and related activities (hereby collectively referred to as Hang Gliding Activities), I hereby understand and agree to this release of liability, waiver of legal rights and assumption of risk and to the terms hereof as follows:
  1. I acknowledge that hang gliding is an action sport and recreational activity involving flight and that such activity is subject to mishap and even injury or death to the participant. I understand I may suffer a broken limb, paralysis or fatal injury while participating in the sport of hang gliding. INITIAL________

  2. I further acknowledge that there are no warranties applicable to the purchase, rental, or lease of the Hang Glider by me and that all warranties whether expressed or implied are excluded. THERE IS NO WARRANTY OF MERCHANTABILITY OR THAT THE SAID HANG GLIDER IS FIT FOR ANY PURPOSE, and I am accepting the said Hang Glider as is and I hereby acknowledge that I examined personally the said Hang Glider prior to my using of the same.   3. I hereby RELEASE, WAIVE, DISCHARGE the following persons, including their owners, officers, directors, agents, employees, spouses, officials (elected or otherwise), members, contractors, sub-contractors, lessors and lessees: Central Carolina Tow To Soar Club, United States Hang Gliding Association, my instructor(s), any airport used for Hang Gliding activities, any field or mountain used for Hang Gliding activities (including but not limited to the area in which launching and or landing may occur), any individual(s) sponsoring and/or participating in the issuance of my proficiency rating, the owners and operators of the equipment and land used for Hang Gliding activities, and any aircraft or vehicle owner or operator providing tow services (hereafter referred to as "Released Parties"), from any and all liability, claims, demands, or causes of action for my personal injury, my bodily injury, my death, and/or my property damage connected with my participation in Hang Gliding activities, including, but not limited to, losses CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES. I understand and acknowledge that Hang Gliding activities have inherent dangers that no amount of care, caution, instruction or expertise can eliminate and I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN HANG GLIDING ACTIVITIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.   5. I further agree that I WILL NOT SUE OR MAKE A CLAIM against the Released Parties for damages or other losses sustained as a result of my participation in Hang Gliding activities. I further agree to INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS from all claims judgements, and costs, including attorney’s fees, incurred in connection with any action brought as a result of my participation in Hang Gliding activities.   6. I will take full responsibility for, and hold harmless Released Parties for any injury that I may suffer or inflict upon others or their property as a result of my engaging in Hang Gliding activities. INITIAL________

  7. I agree that I will operate the said Hang Glider in a reasonable and safe manner so as not to endanger the lives of persons or property of any individual. INITIAL________

  8. I have read and understood the above and acknowledge that the same constitutes a release of liability and a waiver of my legal rights and also acknowledgement of the assumption by me of all risks arising out of my engaging in Hang Gliding activities. INITIAL________

  9. I further represent that this release of liability, waiver of legal rights and assumption of risk shall continue in full force and effect for so long as I engage in Hang Gliding activities which are in any way connected to or with the Released Parties. INITIAL________

  10. I further represent that I am at least 18 years of age, or, that as the parent or legal guardian I waive and release any and all legal rights that may apply to me or to my minor child as the result of any injury that my minor child may suffer while engaging in Hang Gliding activities.   11. I hereby expressly recognize that this Release of Liability, Waiver of Legal Rights and Assumption of Risk is a contract pursuant to which I release any and all claims against the Released Parties resulting from my participation in Hang Gliding activities including any claims caused by the negligence of the Released Parties.
